Terms of carriage and prices

These terms govern the passenger transport service provided by ELEF 53, uslužni obrt, owner Stipo Čolić, Petrinja, Croatia (hereinafter “the carrier” or “we”). By accepting our quote you accept these terms. Anything not covered here is governed by the Croatian Consumer Protection Act, Civil Obligations Act, Road Transport Act and other applicable regulations of the Republic of Croatia. This is a translation; in case of any discrepancy, the Croatian version prevails.

1. Enquiry and ride confirmation

By sending the form on the website, a message or calling us, you send an enquiry. An enquiry is not a booking and is not binding on you or on us.

We reply to the enquiry with a quote stating the date and time, pick-up location, destination and any stops, number of passengers and the total price. The ride is agreed (the contract is concluded) only when you accept the quote and we confirm the time, route and price by e-mail, SMS or message.

2. Prices

We do not publish a fixed price list, as every ride depends on the route, time, number of passengers, extra stops and any waiting. Before confirming the ride we state the price as a total amount in euros (EUR), including all taxes and fees, unless the quote expressly states otherwise. Motorway tolls, tunnel tolls and parking fees on the agreed route are included in the price unless stated otherwise in the quote.

Extra stops, route changes or waiting longer than agreed at the passenger’s request are charged only if you have agreed to them in advance. For transfers from the airport we monitor your flight, and the included waiting time is stated in the quote.

The website does not calculate prices automatically and does not offer online payment.

Payment: in cash or by card in the vehicle after the ride, or by bank transfer before the ride (IBAN: [enter IBAN], Erste & Steiermärkische Bank d.d.). Companies can pay by invoice, by arrangement.

Receipt: we issue a receipt for every ride in accordance with Croatian fiscalisation rules. [If the business is not in the VAT system: “The business is not registered for VAT; VAT has not been charged pursuant to Article 90(1) of the Croatian VAT Act.”]

3. Changes and cancellation

If your plans change, let us know as soon as possible. We try to accommodate changes to the time or route; if they change the price, we confirm the new price before the ride.

  • Cancellation at least 24 hours before the ride – free of charge.
  • Cancellation less than 24 hours before the ride – a fee of [50] % of the agreed price.
  • No-show (if the passenger neither gets in touch nor appears within [60] minutes of the agreed departure time) – the full agreed price is charged.

For intercity and international rides, and rides for which an advance payment has been agreed, the cancellation deadline and fee are stated in the quote and take precedence over these general rules.

Cancellation by us: if we cannot carry out the ride (e.g. vehicle breakdown, driver illness, force majeure), we will inform you immediately and offer alternative transport. If an alternative is not possible or you do not accept it, we will refund the full amount paid.

We are not liable for delays caused by circumstances beyond our control (traffic, road closures, weather, border checks), but we will inform you of them immediately.

Right of withdrawal: the statutory consumer right to withdraw from a distance contract within 14 days without giving reasons does not apply to passenger transport service contracts (Croatian Consumer Protection Act, in line with Directive 2011/83/EU). The cancellation rules in this section apply instead.

4. Vehicle, passengers and luggage

We confirm the number of passengers and amount of luggage for each ride. The number of passengers may not exceed the number of seats stated in the vehicle registration document.

  • All passengers must wear a seat belt during the ride.
  • Children are transported in accordance with the Croatian Road Traffic Safety Act. Please state the need for a child seat or booster in your enquiry (child’s age and height).
  • Smoking, including e-cigarettes, is not permitted in the vehicle.
  • Pets are transported only by prior arrangement, in a carrier or with a protective cover.
  • Dangerous and prohibited substances and items may not be transported.
  • The driver may refuse or stop transporting a person whose behaviour endangers the safety of the ride, the driver or other passengers. Damage caused to the vehicle intentionally or through negligence (e.g. soiling requiring deep cleaning) is borne by the passenger who caused it.

5. International rides

For rides outside Croatia, each passenger is responsible for valid travel documents (ID card, passport, visas) and for complying with customs and currency regulations for the items they carry. Delays or interruptions due to missing documents or a passenger being held at the border are not considered a cancellation by us. We confirm the possibility of an international ride for each enquiry.

6. Liability and insurance

Passengers are insured against the consequences of accidents in accordance with the Croatian Compulsory Traffic Insurance Act. We are liable for damage to luggage in accordance with the Civil Obligations Act. We recommend keeping money, documents, jewellery, electronics and other valuables with you.

Items left in the vehicle are kept for [30] days and returned to the owner by arrangement; delivery costs are borne by the owner.

7. Complaints and dispute resolution

You can submit a complaint in writing:

  • by post to: ELEF 53, Dragutina Benka 22, 44250 Petrinja, Croatia
  • by e-mail to: info@elef53.hr

We will confirm receipt of your complaint without delay and reply in writing within 15 days of receipt, clearly stating whether we accept the complaint as justified (Croatian Consumer Protection Act). We keep records of complaints for one year.

If the dispute is not resolved by agreement, you may turn to a body for alternative resolution of consumer disputes. The carrier is willing to take part in proceedings before the Mediation Centre of the Croatian Chamber of Trades and Crafts, Ilica 49/II, 10000 Zagreb, e-mail: mirenje@hok.hr. You may also file a complaint with the market inspection of the State Inspectorate.
